This Refund & Cancellation Policy applies to all services, products, consultations, and real estate / timeshare-related services offered by HERO : Hawaii Elite Resort Ownership (“we,” “us,” “our”) through HeroAloha.com (the “Website”).

By engaging our services — including consultation, resale assistance, brokerage referral, or any timeshare / real estate–related support — you (“Client”) agree to the terms below.

If you engage our services to purchase or sell a timeshare interest under Hawaii law, you are subject to the statutory protections under the Hawaii Timeshare Law (HRS Chapter 514E). Under that law:

• You have a right to cancel the timeshare contract within seven (7) calendar days after the later of (a) the date you sign the contract or (b) the date you receive the full timeshare disclosure statement.
• If you cancel within that period, you are entitled to a full refund of all payments made (e.g., down payment, deposit, contract fees), assuming you properly deliver written notice of cancellation via hand-delivery or certified mail before the deadline.
• The contract cannot legally waive this right or impose penalty fees for rescission.

If you hire us solely for consultation, advisory, resale-assistance, marketing, or other non-contract-sale services, the statutory timeshare rescission rules may not apply.

For services that are not subject to statutory rescission rights (e.g., consulting, advisory on resale, market assessments, timeshare-exit planning), we apply the following policy:

• All sales are final after delivery of services or digital products (guides, reports, etc.), unless otherwise specified in writing.
• If we schedule a consultation or service appointment:
  • Cancellations made with at least 24 hours’ notice — you may reschedule at no additional cost.
  • Cancellations made with less than 24 hours’ notice — may result in a fee or forfeiture of the session, at our discretion.
  • No-shows — no refunds or credits.
• Digital products (ebooks, guides, templates, reports, etc.) — once delivered, accessed or downloaded — are non-refundable.
• In limited cases (e.g., payment error, duplicate charge, or our failure to deliver the promised service), we may provide a refund or credit at our discretion.
   

Before entering any agreement for timeshare sale or representation:

• We will provide full disclosure of fees, services, and your rights — including the statutory 7-day cancellation window, where applicable.
• You must receive a clear written contract showing all terms before signing, including a separate Disclosure Statement if required by law (per HRS Chapter 514E regulations).
• We will not collect or retain deposits or payments beyond what is legally compliant (e.g., escrow, proper disclosures) when facilitating timeshare sales.
   

• If you wish to cancel a timeshare contract under Hawaii law, send a written cancellation notice (hand-deliver or certified mail) to the address provided in your contract — before the 7-day rescission period ends.
• For cancellations of consultations or services under our policy — contact us via our published email at least 24 hours before the appointment to reschedule or cancel.
• For refund requests (payment errors, duplicates, etc.) — contact us via email with your payment details and explanation; we’ll review and respond within 5 business days.
   

• We reserve the right to refuse refunds or cancellations where statutory protections do not apply, or where services or products have been delivered or used.
• Nothing in this policy is intended to override or circumvent statutory rights provided under Hawaii law — where applicable.
• This policy and any agreement between you and HERO are governed by the laws of the State of Hawaii.
